By accessing https://tradingzing.com or using any product or service provided by Trading Zing, you accept these Terms of Use in full. Do not continue to use the Trading Zing website or services if you do not accept all of the terms and conditions stated on this page.

These Terms of Use (“Terms” or “Terms and Conditions”) govern your use of the https://tradingzing.com website and all services operated by Jynysys IT Pvt Ltd, a company incorporated in India, which owns and operates the Trading Zing brand (“us”, “we”, or “our”). For the purposes of these Terms, “Trading Zing”, “Services”, “Trading Zing Services”, or “Service” refer to the Trading Zing website (tradingzing.com), including all software, content, training materials, videos, and services that Trading Zing operates. The terms “Trading Zing”, “Jynysys IT”, “we”, “us”, and “our” all refer to Jynysys IT Pvt Ltd.

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.

If you do not agree to these Terms, you should not access or use our Services.

1. OPERATOR

This website (tradingzing.com) and the Trading Zing brand are owned and operated by Jynysys IT Pvt Ltd, a private limited company incorporated in India. All payments collected through this website are collected by Jynysys IT Pvt Ltd. References to “Trading Zing”, “we”, “us”, or “our” in these Terms mean Jynysys IT Pvt Ltd.

2. ELIGIBILITY AND TERRITORIAL RESTRICTIONS

By agreeing to these Terms, you represent and warrant to us:

(i) That you are at least eighteen (18) years of age;

(ii) That you have not previously been suspended or removed from the Services;

(iii) That your use of the Services is in compliance with any and all applicable laws and regulations in your jurisdiction;

(iv) That you are not a resident, national, or citizen of, and are not located in or operating from, any of the following restricted jurisdictions: Cuba, Iran, India, North Korea (DPRK), Syria, Russia, Belarus, Myanmar (Burma), Venezuela, Sudan, South Sudan, Yemen, Libya, Somalia, Zimbabwe, Nicaragua, Mali, Central African Republic, Democratic Republic of Congo, United States of America, and the Ukrainian regions of Crimea, Donetsk, and Luhansk; and

(v) That you are permitted under the laws of your country and jurisdiction to purchase, download, and use automated trading software, and that you do so entirely on your own initiative.

The Software and Services are not offered or directed to residents of the countries listed above, and are not intended for use in any jurisdiction where such use would be contrary to local law or regulation. Nothing on this website constitutes an offer or solicitation in any jurisdiction where it would be unlawful to make such an offer. If you access this website from a restricted jurisdiction, you do so at your own risk and you are solely responsible for compliance with local laws.

We reserve the right to restrict access to the Services from any country or jurisdiction at any time, at our sole discretion.

3. NATURE OF THE PRODUCT — SOFTWARE TOOL, NOT FINANCIAL ADVICE

The Software (including all Expert Advisors, .ex5 files, indicators, scripts, and set files) is a technical automation tool only. It executes predefined trading instructions on the user’s own MetaTrader 5 (MT5) platform, through the user’s own broker account.

The Software is not, and must not be construed as:

  • Investment advice or financial advice of any kind;
  • A portfolio management service;
  • A trading signal service or signal provider;
  • A recommendation or solicitation to buy or sell any financial instrument;
  • A managed account or fund management service.

We are a software developer and licensor only. We do not manage your trading account, do not have access to your funds, and do not execute trades on your behalf. No advisory, fiduciary, brokerage, or financial services relationship of any kind is created between you and Jynysys IT Pvt Ltd by your purchase or use of the Software. All trading decisions, including the selection and configuration of the Software, are made solely and entirely by you.

You should seek independent financial advice from a qualified and licensed professional before engaging in any form of trading.

4. RISK WARNING

Trading leveraged products such as foreign exchange (Forex), commodities, and other financial instruments involves a high degree of risk to your capital. You should only trade with money you can afford to lose entirely. Automated trading software does not eliminate or reduce this risk.

You acknowledge and agree that:

  • There is a real possibility of losing your entire invested capital, including on a live account operated by the Software;
  • Past performance of the Software, including any results shown on this website, in testimonials, or in third-party tracking systems, is not indicative of future results and does not constitute a guarantee of any kind;
  • We do not guarantee any profit when using products purchased on this website;
  • The risks of trading and using any products from this website are borne entirely by you.

Please ensure you fully understand the risks involved and seek independent advice if necessary.

5. USER RESPONSIBILITY AND CONFIGURATION

You are solely responsible for:

  • Installing, configuring, and operating the Software correctly, including all parameters, lot sizes, risk settings, money-management options, and stop-loss levels;
  • Your choice of broker, broker account type, leverage, account currency, and instruments traded;
  • Testing the Software thoroughly on a demo account before deploying it on any live trading account;
  • Monitoring your live account and open positions while the Software is running;
  • Ensuring that your broker’s platform, connectivity, and execution environment are suitable for automated trading.

You acknowledge that different configuration settings produce materially different results, and that improper configuration, excessive risk settings, or failure to test on a demo account can cause substantial losses, up to and including the total loss of your account balance.

We are not responsible for any loss, damage, or adverse outcome arising from your configuration choices, your selected settings, your failure to test on a demo account before going live, your failure to monitor open positions, or your choice of broker or trading account.

6. MARKET AND EXECUTION RISK

Trading results depend on market conditions and execution factors that are entirely outside our control, including but not limited to:

  • Market volatility, price gaps, liquidity conditions, and sudden adverse market movements;
  • Slippage, spread widening, requotes, or partial fills by your broker;
  • Economic news events, political events, and other force-majeure circumstances affecting markets;
  • The performance, reliability, and pricing of your chosen broker’s platform and infrastructure;
  • Internet connectivity, VPS or server availability, latency, and power supply;
  • The MetaTrader 5 platform itself, including updates or changes made by MetaQuotes Software Corp;
  • Restrictions or changes imposed by your broker at any time.

We are not liable for any losses arising from any of the above factors, whether or not they occur in combination with any characteristic of the Software.

7. SOFTWARE PERFORMANCE AND WARRANTIES

The Software and all Services are made available to you on an “AS IS” and “AS AVAILABLE” basis. To the maximum extent permitted by applicable law:

  • We make no claims or promises about the quality, accuracy, reliability, or fitness for purpose of the Software;
  • We expressly disclaim all warranties, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement;
  • We do not warrant that the Software will be uninterrupted, timely, secure, error-free, or free of bugs or defects;
  • We do not warrant that results obtained from use of the Software will be accurate, reliable, or profitable;
  • We do not warrant that the Software will continue to function correctly following updates to the MetaTrader 5 platform, changes to broker infrastructure, or changes in market conditions;
  • Automated software may contain errors, may fail to open or close positions as intended, or may behave unexpectedly under certain conditions.

You are responsible for supervising your trading account at all times and for intervening manually where necessary. We are not liable for any loss caused by software defects, malfunctions, downtime, failures to execute, or any interruption in the availability of the Software or Services.

We may remove the Service for indefinite periods of time or discontinue the Service at any time, without prior notice to you.

8. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

(a) IN NO EVENT SHALL JYNYSYS IT PVT LTD, ITS DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SUPPLIERS, SERVICE PROVIDERS, OR LICENSORS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY TRADING LOSSES, LOSS OF PROFITS, LOSS OF DATA, OR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF, OR YOUR INABILITY TO ACCESS OR USE, THE SERVICE OR THE SOFTWARE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.

(b) OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATING TO THE SOFTWARE OR THESE TERMS SHALL IN NO EVENT EXCEED THE TOTAL SUBSCRIPTION FEES ACTUALLY PAID BY YOU TO US IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

(c) THE OWNERS OF TRADINGZING.COM CANNOT BE HELD ACCOUNTABLE FOR ANY TRADING LOSSES THAT MAY OCCUR, INCLUDING LOSSES ARISING FROM SOFTWARE BUGS, GLITCHES, MALFUNCTIONS, INCORRECT USER CONFIGURATION, ADVERSE MARKET CONDITIONS, OR BROKER-RELATED ISSUES.

Because some states or jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, in such jurisdictions our liability shall be limited to the maximum extent permitted by law.

9. ASSUMPTION OF RISK

You acknowledge and agree that:

  • Automated trading can result in the loss of your entire invested capital;
  • You are using the Software entirely at your own risk;
  • You have read, understood, and accepted the risk warnings in these Terms before purchasing or using the Software;
  • You will use the Software only with funds you can afford to lose.

10. LINKS TO OTHER WEBSITES

Our Service may contain links to third-party websites or services that are not owned or controlled by Trading Zing. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites. We are not responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with your use of or reliance on any content, goods, or services available on or through any such websites.

You agree to defend, indemnify, and hold harmless Jynysys IT Pvt Ltd and its officers, directors, employees, consultants, affiliates, and agents from and against any and all claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your access to, use of, or alleged use of the Service.

We strongly advise you to read the terms and conditions and privacy policies of any third-party websites or services that you visit.

11. MEMBERSHIPS, LICENCES, AND PAYMENTS

By ordering any subscription or licence on https://tradingzing.com, you confirm that you have read and accepted these Terms of Use.

The Software licence granted to you is personal, non-transferable, non-sublicensable, and limited to the account and device for which it is issued. You may not share, resell, or redistribute your licence key or the Software.

All sales are final. Please refer to Section 14 (Refund Policy) for full details.

12. PERSONAL INFORMATION

Your submission of personal information through the website is governed by our Privacy Policy, which is incorporated into these Terms by reference.

13. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Jynysys IT Pvt Ltd (operating as Trading Zing), and its directors, officers, employees, agents, contractors, licensors, service providers, and suppliers from and against any claim or demand, including reasonable legal fees, made by any third party arising out of or relating to: (i) your breach of these Terms; (ii) your use or misuse of the Software or Services; (iii) your violation of any applicable law or regulation; or (iv) your violation of the rights of any third party.

14. REFUND POLICY AND CHARGEBACKS

There are no refunds for any products or services offered by Trading Zing. All sales are final.

Refunds or account credits will not be issued in any of the following situations:

  • You have changed your mind about using our product or service;
  • You purchased our product or service by mistake;
  • You do not have sufficient technical expertise to use the Software;
  • You are unable to activate the Software before your subscription or licence expires;
  • You experience dissatisfaction with the Software after purchase;
  • The Software does not perform in a manner that meets your personal profit expectations;
  • Trading losses occur while using the Software.

You agree not to initiate any chargeback or payment dispute with your bank or payment provider in relation to a purchase from Trading Zing. If you have any issue with your purchase, please contact us at [email protected] and we will make every reasonable effort to resolve the matter. Users who have filed a chargeback or dispute are not eligible for any refund or credit.

15. GOVERNING LAW AND JURISDICTION

These Terms are governed by and construed in accordance with the laws of India. Any dispute arising out of or relating to these Terms, the Software, or the Services shall be subject to the exclusive jurisdiction of the competent courts at Mumbai, Maharashtra, India.

Nothing in this clause limits our right to seek injunctive or other equitable relief in any jurisdiction.

16. CHANGES TO THIS AGREEMENT

Trading Zing reserves the right to make modifications to these Terms at any time. Revised versions will be posted to this website with an updated “Last Updated” date. Unless otherwise specified, modifications take effect on the day they are posted. Your continued use of the Services after revisions become effective constitutes your acceptance of the revised Terms. If you do not agree to the new Terms, you must stop using the Services.

17. GENERAL PROVISIONS

Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

Severability: If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions will remain in full force and effect.

Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Jynysys IT Pvt Ltd regarding the Services, and supersede all prior agreements between us.

Assignment: You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations freely.
